On-Campus Dorms vs. Off-Campus Housing — The Key Difference

This is the most important thing Colorado college students need to understand about ESA rights.

On-Campus Dorms (Section 504 + University Policy)

The Fair Housing Act does NOT directly apply to on-campus student housing. Instead, universities must comply with Section 504 of the Rehabilitation Act and the ADA. Each university has its own Disability Services office that handles ESA requests.

  • Must apply through your school's Disability Services (DS) office
  • Your ESA letter supports — but doesn't automatically guarantee — dorm approval
  • DS reviews your documentation and makes the housing accommodation decision
  • Start the process early — it can take 2–4 weeks
  • Approvals are often limited to single rooms or specific dorms

Off-Campus Housing (Fair Housing Act)

For off-campus apartments, houses, or rooms near your Colorado university, the Fair Housing Act applies in full. Landlords must accept a valid ESA letter from a Colorado-licensed clinician — regardless of no-pet policies.

  • Present your ESA letter directly to your landlord or property manager
  • FHA overrides all no-pet policies and breed/weight restrictions
  • No pet deposits can be charged for your ESA
  • Your landlord cannot demand training certificates
  • File with CCRD if your off-campus landlord illegally denies

College Student ESA Colorado — FAQ

Can I get an ESA in my CU Boulder dorm?

Possibly. CU Boulder's Disability Services office reviews ESA requests for on-campus housing under Section 504 of the Rehabilitation Act. You'll need to submit an ESA letter from a licensed clinician as part of your DS application. Approval is not automatic — the DS office makes the final housing accommodation decision.

Do I need to use the university's counseling center for my ESA letter?

No. While using your university's counseling center is one option, our Colorado-licensed clinicians can provide an ESA letter that supports your Disability Services application at any Colorado university. Many students prefer faster processing through a private provider.

My dorm has a no-pets policy. Does my ESA override it?

For on-campus dorms, the Fair Housing Act doesn't directly apply — instead, your university must provide reasonable accommodations under Section 504. Approval is through the DS office, not directly from the FHA. For off-campus housing near your campus, the FHA fully applies.

Can I bring my ESA back to campus each semester?

My college roommate is allergic to my ESA. What happens?

The university must attempt to provide a reasonable accommodation for both students — often by providing separate housing assignments. They cannot simply deny your ESA because of a roommate allergy.
