Fair Housing Act (FHA)
Under the FHA, Colorado landlords must make reasonable accommodations for tenants with an ESA. They cannot charge pet fees, pet deposits, or deny housing solely because of your emotional support animal — regardless of breed or weight restrictions.
HUD Guidelines
The U.S. Department of Housing and Urban Development (HUD) clarified in 2020 that an ESA letter from a licensed Colorado mental health professional is sufficient documentation. Online questionnaires alone are not enough — a real clinical relationship is required.
Colorado Fair Housing Act
Colorado has its own state-level Fair Housing Act that reinforces federal protections. The Colorado Civil Rights Division (CCRD) enforces these laws. Denver, Boulder, Colorado Springs, and Fort Collins landlords are all bound by these rules.
What Colorado Landlords Cannot Do
- Charge pet fees, pet deposits, or monthly pet rent for an ESA
- Enforce breed or weight restrictions on your ESA
- Deny housing based solely on an ESA (with valid ESA letter)
- Request medical records or detailed diagnosis information
- Retaliate against you for requesting reasonable accommodation
- Ignore a properly submitted reasonable accommodation request
When a Landlord May Legally Deny
- •The building has fewer than 4 units and the landlord lives on-site
- •Single-family home sold/rented without a real estate broker
- •The specific animal poses a direct threat (documented, individual assessment)
- •The accommodation would cause undue financial hardship to the landlord
- •Your ESA letter is fraudulent, expired, or from an unlicensed provider
